Abstract

The present article is a translation of the article "L'ordre juridique: un concept historiquement situé", by Benoït Frydman, professor at the Université Libre de Bruxelles. In it, the author intends, firstly, to map the historical moment of the emergence of the notion of "juridical order", linked to modern natural law and more geometric reasoning, arguing that it is not necessary to conceive law as an ordered system of norms. Second, the author gives indications of how and why it may be beneficial to "think law in disorder," particularly in a context of legal globalization.

  • Prof. Dr. Benoit Frydman, Université Libre de Bruxelles - Bélgica

    He is a professor at the Université Libre de Bruxelles. He holds a doctorate in law, a master's degree in philosophy and a special license in economic law. He is a member of the Special Council of Justice of Belgium, a member of the Perelman Center for the Philosophy of Law, the board of directors of the Université Libre de Bruxelles, and co-chair of the reform commission of the Belgian cour d'assises. He was a researcher at the FNRS, Visiting Research Fellow at Wolfson College de l'Université d'Oxford, visiting professor at Sciences-Po/Paris.

    PhD candidate in Philosophy and General Theory of Law at the University of São Paulo (USP). He holds a Master in Law (2018) and Bachelor in Law (2015) from the Pontifical Catholic University of São Paulo(PUC-SP). He holds a B.A. in Philosophy (2019) from the University of São Paulo (USP). He is Coordinator of the Law Course at Nove de Julho School in Osasco, where he also works as a professor. He is a member of the research group "Justice System and State of Exception" at the Pontifical Catholic University of São Paulo (PUC-SP). He is a member of the research group "Philosophy of Law and Political Thought" at the Federal University of Paraíba (UFPB) He is an associate member of the Brazilian Association of Philosophy of Law and Sociology of Law (ABRAFI), Brazilian section of the Internationale Vereinigung für Rechts und Sozialphilosophie ? IVR.
