Judicialization of politics, judicial activism and institutional tensions

Is it possible to specify the literal meaning of a law? If the Judiciary plays a fundamental role in stabilizing society's normative expectations, how far does judges' interpretive freedom go in the face of the multiplicity of hermeneutical alternatives, argumentative perspectives and decision-making methods? What is the boundary between discretion and discretion in the interpretation of a legal norm? How to detect when judges go beyond understanding legal rules, redefining what the law should be? This paper presents the process of Brazilian redemocratization and the dilemmas with which politics and law had to deal since the end of the military dictatorship and with the country's redemocratization.
