Vol. 4 No. 5 (2025): Revista Bindi: cultura, democracia e direito

This Dossier starts from the contradiction between the protective function of the modern State, as described in classical theories such as Hobbes’s, and the historical reality of violence against Indigenous peoples in Brazil. Cases like that of the Kaiowá and Guarani illustrate how the State has acted — and continues to act — in the oppression of these populations. The goal is to gather data and analyses on how Indigenous rights are recognized, enforced, or violated. It seeks to discuss the intersections between state law and Indigenous rights, with emphasis on sovereignty, self-determination, and territorial conflicts. The proposal is to critically reflect on state omissions and violence. It aims to contribute to the construction of a plural and inclusive Rule of Law.
